The struggling mall-based cookie chain, Mrs. Fields, has announced plans to file for bankruptcy. The privately held company stated that it would seek protection from its creditors under Chapter 11 of the US bankruptcy code. The company faces both increasing costs and a reduction in consumer concessionary spending, which has caused a loss of $10.7 million in the most recent quarter. The company carries about $200 million in debt. Mrs. Fields was founded in the late 1970s and has grown, through a franchise model, to almost 1,200 stores. |

Former Federal Reserve Chairman Alan Greenspan stated that he expects US housing prices will stabilize in the first half of 2009. Greenspan continue to criticize the government's bail out of mortgage titans Freddie Mac and Fannie Mae. In an interview with the Wall Street Journal, Greenspan stated that "They should have wiped out the shareholders, nationalized the institutions with legislation that they are to be reconstituted... as five or 10 individual privately held units." Greenspan was also critical of the Fed's intervention to support Bear Sterns. |

The CEO of British Airways, Willie Walsh, announced that he has entered into an alliance with American Airlines [NYSE:AMR] that will permit the two companies to agree on routes, schedules and fares. The agreement would also include Iberia, Spain's national carrier and OneWorld partner. The agreement includes flights from the US, Canada and Mexico to EU countries; it would also extend to Switzerland and Norway. Before implementation of the agreement, the carriers would have to seek immunity from anti-competitive laws from the US Department of Transportation. European authorities would also likely have to sign-off on such a deal. Virgin Atlantic, one of the largest transatlantic competitors of the two carriers, has objected to the agreement. |

Home foreclosures increased by 55% in July over same month in the previous year. The rate of foreclosures is expected to decline in August as various state initiatives delay the ability of banks to seize a property. Such initiatives include 30 to 60 day grace periods, which are designed to encourage banks to seek settlements with their customers. Many experts believe that, once these periods of delay have passed, foreclosures will surge again at year's end. |

Wal-Mart Stores, Inc. [NYSE:WMT] reported its sales and earnings for the quarter ended July 31, 2008. Net sales for the second quarter of fiscal year 2009 were approximately $101.6 billion, an increase of 10.4 percent from $92.0 billion in the second quarter last year. Earnings grew by 17% from 72 cents per share in 2007 to 87 cents in the most recent quarter. The results beat analysts' expectations. Income from continuing operations for the second quarter was $3.385 billion, an increase of 9.3 percent from $3.097 billion in the second quarter last year. Diluted earnings per share from continuing operations for the second quarter of fiscal year 2009 increased to $0.86 from the previous year’s second quarter result of $0.75 per share (after reclassifying for discontinued operations, as noted below). The prior year included a net benefit of $0.04 per share from three items: the net impact of a reduction of general liability and workers’ compensation claim accruals, gains from the sale of certain real estate properties, and charges for legal and other contingencies. “For the third quarter of fiscal year 2009, we estimate the Company’s comparable store sales increase in the United States to be between one and two percent, which continues to reflect some sales volatility from week to week,” said Tom Schoewe, Wal-Mart Stores, Inc. executive vice president and chief financial officer. “We expect the Company’s earnings per share from continuing operations for the third quarter to be between $0.73 and $0.76 and are raising our current forecast for earnings from continuing operations for the full fiscal year to a range of $3.43 to $3.50 per share.” After this earnings release has been furnished to the SEC, a pre-recorded call offering additional comments on the quarter will be available to all investors. Inflation surged in July to an annual rate of 5.6% triggered by price increases in energy, food, transportation (airlines) and clothing. With the strengthening dollar and the softening price of crude oil, the rate of inflation is expected to moderate in August. While the consumer price increased (CPI) by 0.8% from June to July, the core rate, measures inflation by excluding price increases in food and energy, jumped by only 0.3%. Both figures were higher than the anticipated increase of 0.4% in the CPI and 0.2% in the core rate. |

As was anticipated, Genentech [NYSE:DNA] has declined Roche's $43.7 billion offer to merge. Interesting, the company left open the possibility of a take-over if the purchase price is raised. Charles Sanders, chair of the committee reviewing the Roche offer said "The special committee is confident in the company's strong financial and clinical momentum and its uniquely productive research and development capabilities, which will continue to enhance shareholder value." To complete the deal, Roche has to convince a majority of the non-Roche shareholders to vote in favor of the merger. |
